Chapter 01 · Tax on trades and investments

The label changes the tax

Two trades with the same rupee profit can fall under different tax labels, and the label changes the rate, the forms, and whether losses can be set off. This chapter sorts the labels a retail reader in India actually meets. It does not compute your tax. Rates, surcharge, and the Finance Act change; a chartered accountant computes the year.

The label follows the activity, not the app folder

Delivery of listed equity, held as an investment, is taxed as capital gains. The holding period decides whether the gain is short-term or long-term. For listed equity the long-term threshold has for years been twelve months, but you confirm the threshold in force for the year you file, because a definition is exactly the sort of thing a budget can amend. Intraday equity, squared off the same day, is not capital gains. It is speculative business income. Equity and index futures and options are business income too, and the law treats them as non-speculative, which matters when you try to set a loss against other income.

The same share can visit more than one label if you are careless with records. Shares you intended to invest, and shares you traded in and out of, need a method you can explain. The tax department is not bound by the watchlist name you typed into a broker app.

What the label changes

ActivityUsual labelA consequence people miss
Listed shares bought and sold after deliveryCapital gains, short or long by holding periodThe period is measured by the rules for that asset, not by the number of sessions you watched it.
Same-day equity square-offSpeculative business incomeA loss here cannot be set off against your salary. It lives inside the speculative bucket, with its own carry-forward rules.
Futures and optionsNon-speculative business incomeTurnover for an audit threshold is computed under the tax rules for derivatives, which is not the same as your profit and not the same as the contract value added up naively.
DividendsIncome from other sources, in the current frameworkThe company does not automatically finish your tax. Your slab still matters.
The label follows the activity. A chartered accountant computes the year. This chapter does not.

Losses are not a refund

A loss is useful only where the law lets you set it against a gain of a permitted kind, in this year or a later year, and only if you file on time. A speculative loss does not freely cancel a capital gain. A long-term loss does not freely cancel a short-term gain in the way a person staring at a single red app screen might hope. Write the buckets down before you net anything to zero in your head. The form will not let you net them just because the total feels unfair.

What this chapter will not do

It will not state a rate. Short-term and long-term equity rates, the surcharge above various incomes, and the availability of indexation on other assets have all been amended in recent years. A number copied from a chapter would be the wrong number for someone, soon. Use the Income Tax Department’s current instructions or a chartered accountant for the year of the transaction. Use this chapter only to arrive at the meeting knowing which bucket each trade sits in, and carrying the contract notes that prove it.

What to remember

  • Delivery equity, intraday equity, and derivatives do not share a tax label just because one broker app showed all three.
  • Holding period sorts capital gains. It does not sort business income.
  • A loss offsets only what the law allows, and often only if you filed on time.
  • Derivative turnover for audit rules is a defined calculation. Do not invent it from contract values.
  • Look up the year’s rates. Do not take them from a lesson.
